1 Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Player", "User", "you") and pk38 ("pk38", "we", "us", "our"), the operator of the online gaming platform accessible at pk38.bio. By registering an account on the pk38 platform, logging in, making a deposit, placing any bet or wager, or using any feature of the pk38 platform in any way, you agree to be fully bound by these Terms, our Privacy Policy, our Responsible Gaming Policy, and any supplementary rules or promotional terms published on the platform.

These Terms apply to all users of the pk38 platform regardless of their location, device or method of access. If you access pk38 through a mobile browser, desktop browser or any other interface, these Terms apply equally.

pk38 reserves the right to update, amend or replace these Terms at any time. Continued use of the platform following any such amendment constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2 Eligibility

To register and use the pk38 platform, you must satisfy all of the following eligibility criteria at all times:

• Age: You must be at least 21 years of age. pk38 strictly prohibits use of the platform by persons under 21. This age restriction is actively enforced through identity verification procedures.
• Legal Capacity: You must have the full legal capacity to enter into a binding agreement under the laws applicable to you.
• Not Self-Excluded: You must not be subject to a self-exclusion order, either voluntarily applied through the pk38 platform or imposed by any relevant gaming authority.
• Not a pk38 Employee: Current employees, contractors, agents and immediate family members of pk38 and its affiliated entities are not permitted to hold player accounts or participate in real-money gaming on the platform.
• Single Account: You must not already hold an active or suspended pk38 account. Each individual is permitted one account only.

pk38 reserves the right to request documentation confirming your eligibility at any point. Failure to provide satisfactory documentation may result in suspension of your account and withholding of any pending withdrawals pending verification.

3 Account Registration

To access real-money gaming features on the pk38 platform, you are required to complete the account registration process. During registration, you must provide accurate, complete and current information including your full legal name, date of birth, residential address and contact details.

You are responsible for maintaining the confidentiality of your pk38 login credentials, including your username and password. You must not share your account access with any other person. pk38 will not be held liable for any losses arising from unauthorised access to your account resulting from your failure to keep your credentials secure.

• Accuracy of Information: All registration details must be truthful and accurate. Providing false information constitutes a material breach of these Terms.
• Account Security: You must use a strong, unique password for your pk38 account. We recommend enabling two-factor authentication where available.
• Notification of Changes: You must promptly update your account information if any of your details change. Outdated information may delay withdrawal processing.
• One Account Rule: Opening more than one account is strictly prohibited. If duplicate accounts are discovered, pk38 may close all associated accounts and forfeit any balances therein.

pk38 reserves the right to refuse registration to any applicant at its sole discretion, without being required to provide a reason for such refusal.

4 Identity Verification (KYC)

pk38 operates a Know Your Customer (KYC) verification process in accordance with the requirements of our international gaming licence. KYC verification is mandatory before any withdrawal is processed and may be requested at any point during your use of the platform.

You may be required to submit one or more of the following documents as part of the KYC process:

• Proof of Identity: A valid Pakistani Computerised National Identity Card (CNIC), passport or other government-issued photo identification document.
• Proof of Address: A recent utility bill, bank statement or other official document confirming your residential address, dated within the last three months.
• Proof of Payment Method: Documentation confirming ownership of the payment method used for deposits, such as a screenshot of your JazzCash or EasyPaisa account registered under the same name as your pk38 account.
• Source of Funds: In certain cases, pk38 may request documentation confirming the legitimate source of funds deposited into your account.

pk38 will process KYC documents in a timely manner. Withdrawals will not be released until KYC verification is successfully completed. pk38 is not liable for any delays in withdrawal processing caused by a player's failure to provide requested documentation promptly.

5 Deposits & Withdrawals

All financial transactions on the pk38 platform are conducted in Pakistani Rupees (PKR). pk38 supports the following payment methods for both deposits and withdrawals: JazzCash, EasyPaisa, HBL, UBL, Meezan Bank, SadaPay and USDT TRC20.

• Deposit Ownership: You may only deposit funds from payment accounts registered in your own name. Third-party deposits are strictly prohibited.
• No Chargeback: By depositing funds into your pk38 account, you agree not to initiate chargebacks or payment reversals through your bank or payment provider. Chargebacks constitute fraud and will result in immediate account suspension.
• Withdrawal Eligibility: Withdrawals may only be processed to the same payment method used for the most recent deposit. KYC verification must be complete before any withdrawal is released.
• Dormant Accounts: Accounts with no login activity for twelve (12) consecutive months may be classified as dormant. pk38 reserves the right to apply a monthly administrative fee of up to PKR 500 to dormant account balances after the dormancy period, subject to applicable law.
• Currency: pk38 does not perform currency conversion. All balances, bets and payouts are denominated in PKR.

pk38 reserves the right to withhold withdrawal payments pending satisfactory completion of KYC verification, responsible gaming checks or fraud investigations. Players will be notified of any such hold promptly.

6 Bonuses & Promotions

pk38 offers various promotional bonuses, including welcome bonuses, deposit match offers, free spins, cashback promotions and loyalty rewards. All bonuses are subject to the following general terms, in addition to any specific terms attached to the individual promotion:

• Wagering Requirements: Bonus funds are subject to wagering requirements before they can be withdrawn. The applicable wagering multiplier will be stated in the specific promotion terms. Failure to meet wagering requirements within the specified time window will result in the bonus and any winnings derived from it being forfeited.
• Eligible Games: Not all games contribute equally to wagering requirements. Slots typically contribute 100%. Live casino and table games may contribute at a reduced rate or not at all, as specified in the individual promotion terms.
• One Bonus at a Time: Only one bonus may be active on a pk38 account at any given time unless explicitly stated otherwise.
• Bonus Abuse: Any attempt to exploit bonuses through systematic wagering strategies designed to circumvent wagering requirements, use of multiple accounts, or any other method deemed abusive by pk38 will result in cancellation of the bonus and may lead to permanent account suspension.
• Maximum Bet Under Bonus: While a bonus is active, the maximum stake per bet or spin is PKR 2,000 unless otherwise specified. Bets exceeding this limit while a bonus is active may be voided.

pk38 reserves the right to modify, suspend or withdraw any promotional offer at any time without prior notice. Bonuses have no cash value and may not be transferred between accounts.

7 Game Rules & Fairness

All games available on the pk38 platform, including slots, live casino tables, Teen Patti, cricket betting and other titles, are governed by individual game rules accessible within each game interface. In the event of any inconsistency between individual game rules and these Terms, the individual game rules shall prevail with respect to gameplay, while these Terms shall prevail in all other respects.

pk38's Random Number Generator (RNG) systems are certified by independent third-party testing laboratories to ensure genuinely random and fair outcomes across all applicable games. Published Return to Player (RTP) percentages for slot games represent theoretical long-term averages and do not guarantee individual session outcomes.

For sports betting, all settled markets are final once officially confirmed by pk38's sportsbook team. In the event of data feed errors or clearly incorrect odds being offered, pk38 reserves the right to void bets placed at manifestly incorrect prices.

8 Prohibited Conduct

The following activities are strictly prohibited on the pk38 platform. Engaging in any prohibited conduct may result in immediate account suspension, forfeiture of account balances and, where appropriate, reporting to law enforcement or relevant regulatory authorities:

• Fraudulent Deposits: Using stolen, unauthorised or fraudulently obtained payment credentials to fund a pk38 account.
• Money Laundering: Using the pk38 platform for the purpose of laundering funds derived from criminal or illegal activity.
• Collusion: Coordinating with other players in live casino or poker games to gain an unfair advantage.
• Arbitrage Betting: Placing bets systematically to exploit pricing inconsistencies across markets with guaranteed profit outcomes.
• Automated Software: Using bots, scripts or automated software to interact with the pk38 platform in a manner not intended for human users.
• Harassment: Engaging in abusive, threatening or harassing behaviour toward pk38 staff or other players through any channel.
• Underage Gambling: Allowing or facilitating any person under the age of 21 to access or use a pk38 account.

9 Responsible Gaming

pk38 is committed to promoting responsible gaming practices. We provide a suite of player protection tools accessible directly from your pk38 account settings. These include deposit limits, loss limits, session time reminders, cooling-off periods and self-exclusion.

Self-exclusion requests take effect immediately across all pk38 gaming categories and remain in force for the duration chosen by the player. Self-exclusion periods cannot be shortened once activated. Players wishing to self-exclude may do so through their account settings or by contacting pk38 support directly.

By using the pk38 platform, you acknowledge that online gaming carries a risk of financial loss and that you are solely responsible for the decisions you make while gaming. pk38 does not accept liability for losses sustained during gameplay, provided the platform has functioned correctly.

10 Account Suspension & Closure

pk38 reserves the right to suspend, restrict or permanently close any player account at any time, with or without prior notice, for any of the following reasons:

• Breach of any provision of these Terms and Conditions.
• Failure to complete KYC verification within a reasonable timeframe.
• Suspicion of fraudulent activity, money laundering or abuse of the platform.
• Receipt of a chargeback or payment reversal from a player's payment provider.
• Court order, regulatory direction or law enforcement request.
• Player request for voluntary self-exclusion or account closure.

Upon permanent closure of an account in good standing, any remaining real-money balance will be returned to the player via their registered payment method, subject to completion of KYC verification. Bonus balances are non-refundable upon account closure. Balances forfeited as a result of Terms violations will not be returned.

Players wishing to voluntarily close their pk38 account may do so by contacting support. Voluntary closure requests will be processed within five business days.

11 Intellectual Property

All content on the pk38 platform, including but not limited to software, game code, graphics, text, logos, trademarks, audio, video and user interface elements, is the intellectual property of pk38 or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the pk38 platform for personal, non-commercial entertainment purposes only. This licence does not include any right to reproduce, distribute, modify, create derivative works from, publicly display or commercially exploit any content from the pk38 platform without the express prior written consent of pk38.

The pk38 name, logo and associated brand identifiers are registered trademarks. Unauthorised use of pk38's trademarks is strictly prohibited and may result in legal action.

12 Limitation of Liability

To the maximum extent permitted by applicable law, pk38 and its officers, directors, employees, agents and licensors shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or relating to your use of the pk38 platform, including but not limited to:

• Loss of gaming winnings due to technical malfunction or system error, where the platform has operated correctly and the error was outside pk38's reasonable control.
• Losses resulting from the player's own failure to comply with these Terms.
• Losses resulting from unauthorised access to a player's account caused by the player's failure to maintain secure login credentials.
• Interruption of service due to maintenance, technical upgrades or force majeure events including natural disasters, regulatory actions or infrastructure failures.

pk38's total aggregate liability to any player in respect of any claim shall not exceed the total amount deposited by that player into their pk38 account in the thirty (30) days preceding the event giving rise to the claim.

13 Privacy & Data Protection

pk38 collects, stores and processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms and Conditions. By registering an account on the pk38 platform, you consent to the collection and use of your personal data as described in the Privacy Policy.

pk38 does not sell, rent or share your personal data with third parties for marketing purposes without your explicit consent. Data is shared only where required for the operation of the platform, including with payment processors, KYC verification providers and our licensing authority, or where required by law.

14 Amendments to These Terms

pk38 reserves the right to amend, update or replace these Terms and Conditions at any time. When material changes are made, pk38 will publish the updated Terms on the platform and update the "Last Updated" date at the top of this page. Where changes are significant, pk38 may also notify registered players by email.

Your continued use of the pk38 platform after the publication of updated Terms constitutes your acceptance of those updated Terms. If you do not agree with any amendment, you must cease using the platform and may request voluntary account closure.

15 Governing Law & Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which pk38 holds its international gaming licence. Any disputes arising out of or in connection with these Terms shall first be referred to the pk38 customer support team for resolution through good-faith negotiation.

If a dispute cannot be resolved informally within thirty (30) days of it being raised with pk38 support, both parties agree to submit the dispute to binding arbitration under the rules of the arbitral body designated by pk38's licensing authority. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.
